Termini e condizioni del servizio

Terms of Service

Draft for operational verification. The store domain, contact email, and Italy as the intended market were supplied for this draft. The operator’s legal identity, registration and tax status, actual data practices, product catalogue, fulfilment locations, installed apps, advertising pixels, Shopify enhanced-service settings, and cookie configuration have not been independently verified. Conditional descriptions must be checked against the live storefront and verified business records before publication. This document is general compliance drafting and not legal advice for a particular business.

These Terms govern use of malverique.shop and purchases made through the store. “We,” “us,” and “our” refer to the business operating the storefront. Review these Terms together with our Return and Refund Policy, Shipping Policy, Privacy Policy, and Legal Notice before ordering. Nothing in these documents excludes rights that applicable law makes non-waivable.

1. Eligibility and Permitted Use

You must have legal capacity to enter into the transaction or act with appropriate authority and supervision. Use the website for lawful purposes and provide accurate information when ordering or contacting us. You must not impersonate another person, use an unauthorized payment method, transmit malicious code, interfere with security, or attempt to access another customer's information.

2. Product Information and Availability

Product descriptions, options, prices, and availability are displayed on the website. We take reasonable care to keep them accurate. Screen differences may affect color appearance, but this does not excuse delivering goods that materially differ from their description.

We may update the selection or correct errors prospectively. If a material error affects an order you placed, we will explain it and seek your agreement to any change or cancel and refund the affected order. We will not impose a higher price or substitute a materially different product without your consent.

3. Orders and Acceptance

Submitting an order is an offer to purchase the selected goods. An automated acknowledgment confirms receipt; acceptance occurs when we issue a dispatch confirmation, unless we expressly confirm acceptance earlier. If we take payment before acceptance and cannot accept the order, we will promptly refund it.

We may decline an order for a legitimate reason, such as unavailability, an unsupported delivery destination, an unresolved payment issue, suspected fraud, or a legal restriction. Decisions will be made consistently with applicable law. We will notify you using the contact information associated with the order.

4. Prices, Taxes, Payment, and the Order Button

Prices and mandatory charges must be shown clearly in euros unless another currency is selected. Total prices include value-added tax where required. Delivery charges and unavoidable costs are disclosed before the order is submitted; standard shipping is normally free.

The checkout must make the obligation to pay unambiguous before the order is placed, clearly present the essential pre-contract information required by Article 49 of the Italian Consumer Code, and use a final control whose wording unmistakably indicates that submitting the order creates a payment obligation. If mandatory formation requirements are not met, the legal consequences are determined by the Italian Consumer Code and other applicable law.

We do not charge more than the displayed total without consent.

5. Delivery, Withdrawal, and Returns

Accepted orders receive free standard shipping. Normal processing is 0–1 business days and estimated transit is 3–7 business days, for an approximate total of 3–8 business days. Zero processing days means same-business-day processing is possible, not guaranteed. Unless otherwise agreed, Article 61 of the Italian Consumer Code generally requires delivery without undue delay and no later than 30 days after contract conclusion.

Consumers normally have a 14-day statutory right of withdrawal under Articles 52 and following of the Italian Consumer Code and then 14 days to return goods after declaring withdrawal. For eligible contracts concluded online, the live interface must provide the withdrawal function required by Article 54-bis. We additionally offer an eligible 30-day voluntary return period.

Approved refunds are credited to the original payment method within seven calendar days after approval, including provider posting time, without an additional bank delay. The mandatory reimbursement rules in Article 56 of the Italian Consumer Code remain controlling. The Return and Refund Policy and Shipping Policy provide details.

6. Intellectual Property and Customer Content

Website text, designs, images, and other content belong to their respective owners or licensors. You may use the website to shop and keep reasonable personal records of your transactions. Commercial copying, redistribution, or misuse of protected content requires permission unless otherwise allowed by law.

If you voluntarily submit a review or product feedback for publication, you retain ownership and grant us a nonexclusive permission to display and reproduce it for that purpose. Do not include unlawful content, third-party confidential information, or material you have no right to submit. Nothing here restricts honest consumer reviews or imposes a penalty for lawful criticism.

7. Third-Party Services and Website Availability

Checkout, hosting, payment, and linked services may be supplied by third parties. Separate provider terms may apply to your use of their services. We remain responsible for our own obligations to you as the seller.

Website availability may be interrupted by maintenance, technical faults, or events outside reasonable control. We will make reasonable efforts to address problems affecting orders. Such events do not excuse a refund, notice, or other remedy required by law.

8. Statutory Conformity, Repair Rights, Warranties, and Liability

Goods must comply with the conformity requirements in Articles 128–135-septies of the Italian Consumer Code. Remedies may include repair or replacement without cost and, where the statutory conditions are met, a proportionate price reduction or termination. For new goods, responsibility generally covers a lack of conformity appearing within two years after delivery, and a defect appearing within one year is generally presumed to have existed at delivery unless the presumption is incompatible with the goods or defect.

Where repair is performed as the conformity remedy, Article 133(1-bis) of the Italian Consumer Code extends the seller's liability period once by twelve months. Before providing the remedy, we explain the consumer's choice between repair and replacement subject to the statutory conditions and the applicable extension. These protections apply according to the statutory scope and transitional rules.

Nothing excludes liability for intent, gross negligence, injury to life, body or health, product liability, fraudulently concealed defects, an expressly assumed guarantee, or another liability that cannot legally be limited. Any limitation for ordinary negligence applies only to the extent permitted and does not deprive consumers of the essence of a material contractual obligation.

9. Governing Law, Courts, and Mandatory Consumer Rights

These Terms and contracts formed through the store are governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods where exclusion is permitted. A consumer is not deprived of mandatory protections of the country of habitual residence under applicable European conflict-of-laws rules.

Statutory jurisdiction rules apply. We do not impose an exclusive venue that is ineffective against a consumer, require binding arbitration, or prevent complaints to a regulator, payment provider, consumer advice body, alternative dispute-resolution entity where applicable, or a competent court.

10. Meaning of Key Transaction Terms

Dispatch means physical transfer to the carrier. Business days are Monday through Friday excluding applicable public holidays; calendar days include weekends and holidays.

11. Information Presented Before Purchase

Before a consumer is bound, the storefront must provide the trader's verified identity and contact details, main characteristics of the goods, total price and taxes, delivery charges, payment and delivery arrangements, complaint handling, legal-conformity information, withdrawal instructions, return-cost allocation, contract duration where relevant, the location of the Article 54-bis withdrawal function, and the other information required by Articles 49 and following of the Italian Consumer Code and Legislative Decree No. 70/2003.

The checkout must permit correction of input errors, identify accepted payment means and delivery restrictions, use the statutory payment-obligation button, and provide the contract information and confirmation on a durable medium. Before publication, all mandatory trader-identity and contact disclosures must be verified against official operator records.

The live storefront must display the harmonised legal-guarantee notice required by Article 65-ter of the Italian Consumer Code and the applicable pre-contract information rules. Where the relevant conditions are met, it must also provide the harmonised commercial durability-guarantee label, software-update information, repairability or repair information, and available environmental delivery information. A general policy does not replace the required notice or product-specific disclosures.

12. Electronic Communications and Transaction Records

We may communicate through the email address or telephone number associated with the order for acknowledgments, verification, dispatch information, returns, refunds, and problem resolution. Please maintain accurate contact details and keep records relevant to your purchase. Contact us if an expected confirmation does not arrive after checking your spam folder.

Agreement to receive necessary order communications does not automatically constitute consent to optional promotional communications. Where electronic notices require a particular form of consent or delivery, we will follow the applicable requirements. A message sent to an incorrect address does not automatically satisfy a legal notice obligation if the law requires something more.

13. Verification, Fraud Checks, and Payment Holds

We may reasonably review payment authorization, address information, and unusual order characteristics to protect against fraud. If additional information is needed, the request should be proportionate to the issue. A verification step must not be used to collect unrelated sensitive information or indefinitely defer an existing shipping obligation.

A payment authorization may temporarily reduce available funds before a transaction is fully captured. Your payment provider controls its authorization-release process. If we cancel an order, we will take the appropriate step to cancel an uncaptured authorization or refund a captured payment. We will explain the action taken rather than describe every payment hold as a completed charge.

14. Offers, Reference Prices, Reviews, and Pricing Errors

Promotions, reference prices, reductions, countdowns, availability claims, reviews, and charges must be accurate under the Italian Consumer Code and Legislative Decree No. 145/2007. Any required prior-price reference, including the lowest price applied during the preceding period where applicable, and the method of calculation will be used.

We do not use fabricated reviews, hidden charges, false scarcity, or invented urgency. A listing error will be explained with lawful options; we will not charge more, substitute goods, or retain payment for goods not supplied.

15. Order Changes and Consumer Withdrawal

Contact hello@malverique.shop promptly to request a change or pre-dispatch cancellation. We will try to accommodate operational changes, but fulfilment progress does not remove statutory withdrawal rights.

A consumer may normally withdraw by any clear statement within 14 days after possession and return the goods within a further 14 days, subject to Articles 52–59 of the Italian Consumer Code. The Article 54-bis function must remain accessible during the withdrawal period, be labelled “recedere dal contratto qui” or an equally unambiguous equivalent, use a “conferma recesso” confirmation step, and send prompt confirmation on a durable medium. The voluntary 30-day policy provides additional time for eligible goods.

16. Shipping Commitments and Delay Notices

The normal estimate is 0–1 business days for processing and 3–7 business days in transit, for approximately 3–8 business days total. Business days are Monday through Friday excluding public holidays applicable at the relevant processing location.

If timely delivery is essential and the statutory conditions are met, or if delivery is refused, a consumer may be entitled to terminate without an additional period. Otherwise, the consumer may set a reasonable additional period and terminate if delivery still does not occur. Article 61 of the Italian Consumer Code and other mandatory rules govern late delivery and reimbursement.

17. Delivery Evidence and Allocation of Responsibility

Provide an accurate deliverable address and any relevant unit or building information. If delivery fails because of an address error, we will review the facts and explain any lawful redelivery options or costs before arranging another shipment. We bear costs attributable to our own error rather than automatically charging the customer.

Delivery scans, photographs, signatures, and customer information may help establish what occurred, but no single tracking status automatically resolves every dispute. If a parcel is misdelivered or lost while we remain responsible for it, an appropriate remedy will be provided. The Shipping Policy explains additional procedures without limiting mandatory consumer protections.

18. Returns, Refunds, and Return Instructions

Eligible voluntary return requests may be made within 30 calendar days after delivery. Statutory distance-cancellation and faulty-goods rights apply separately. Contact hello@malverique.shop for return-routing instructions before sending a parcel so it can be identified, but a missing internal authorisation number does not extinguish a valid statutory right.

Approved refunds are returned to and credited to the original payment method within 7 calendar days after approval, including payment-provider posting time, with no added bank delay. Statutory cancellation refunds are also made within the shorter applicable legal deadline. Change-of-mind return costs and faulty-goods costs are allocated as described in the Return and Refund Policy and applicable law.

If an approved refund has not been credited within 7 calendar days after refund approval, contact hello@malverique.shop so we can trace and resolve it. Any shorter mandatory legal deadline takes precedence.

19. Acceptable Use of the Storefront

You must not interfere with checkout, bypass access controls, submit fraudulent transactions, misuse another person's account information, upload malicious code, impersonate our business, or falsely claim authority to act for us. Lawful browsing and legitimate consumer complaints remain permitted.

We may take proportionate steps to protect the service from misuse. Suspending access does not remove an obligation to fulfill or refund an existing lawful order, respond to a valid privacy request, or provide a legally required remedy. Where appropriate, we will provide a way to contact us about an affected transaction.

20. Reviews, Feedback, and Content Moderation

Public submissions must be lawful and respect privacy and intellectual property. We may remove unlawful material or spam without restricting honest consumer criticism.

21. Privacy and Independent Service Terms

Personal information is handled as described in the Privacy Policy. These Terms do not create blanket consent to every possible form of data processing. Optional marketing, cross-service tracking, and other activities that require a distinct notice or choice must be handled according to applicable privacy law.

An independent payment or third-party service may apply its own terms to that separate service. Those terms do not override our seller obligations, contractual commitments, or the customer's mandatory rights.

22. Product Conformity, Safety, and Recalls

Contact us if a product appears unsafe, defective, misdescribed, or unfit for purpose. Stop using an item where continued use could create a risk. We will assess the report, provide an appropriate remedy, and cooperate with applicable product-safety and recall obligations.

Care instructions and warnings should be followed, but they do not excuse a pre-existing defect or remove statutory rights. A manufacturer’s warranty is additional to consumer remedies against the seller. Where a safety recall applies, instructions and remedies will be communicated without imposing an inappropriate charge.

23. Liability, Mitigation, and Events Outside Control

Liability is determined under applicable law. No blanket purchase-price cap excludes mandatory claims. Consumers retain rights concerning losses legally attributable to our breach.

Severe weather, government action, carrier interruptions, and similar events can affect performance. We will take reasonable steps to address the effect and communicate about affected orders. Such events do not authorize indefinite retention of payment for unshipped goods or erase legally required cancellation, refund, or product-safety obligations.

24. Complaints, Consumer ADR, and Continuing Rights

Email hello@malverique.shop with the order number and a clear description of the complaint. We will investigate and explain our response. Direct contact is encouraged but is not a condition of a lawful card dispute, regulatory complaint, consumer advice request, alternative dispute resolution, or court claim.

A consumer may submit an eligible dispute to an Italian alternative dispute-resolution entity listed by the competent authorities, use assistance from a consumer association or European Consumer Centre, complain to a competent regulator, or go to a court with jurisdiction. Any trader obligation or commitment to participate in a particular ADR scheme must be stated accurately after verification. The former EU Online Dispute Resolution platform is not presented as available because it was discontinued on 20 July 2025.

25. Changes, Severability, and Contact

Updated Terms will be posted and apply prospectively. The terms agreed for an existing purchase continue to govern that purchase unless a lawful change is separately agreed. If a provision is unenforceable, the remaining provisions continue to the extent legally possible. Failure to enforce a provision immediately is not a waiver of future lawful enforcement.
